Australian sperm donor loses fight with lesbian couple

NSW, Australia, 17 Aug 2011 – An Australian man who donated sperm to a lesbian couple has been told by a court that his name must be removed from the child's birth certificate.
A court in Sydney ruled that the birth mother's former partner had the right to have her name on the certificate, even though the couple split in 2006. Expressing sympathy for the father, the judge said he had no contractual right to be registered on the certificate.
According to the BBC, this is the first time a name has been forcibly removed from a birth certificate in Australia. The case has led to suggestions from both Judge Walmsley and the donor that the law should be rethought to allow for three parents to be listed on a birth certificate. Judge Walmsey said, 'the case highlights the inadequacy of laws dealing with multi-parent families'.
In a 2007 precedent on the use of names on a birth certificate, a Canadian court allowed the addition of a third name onto a five-year old boy's birth certificate to allow for the mother's new partner to have legal status as parent.
